Nepal’s IT Regulation Update: IT Department Approval Required for Ventures Proposed

The Ministry of Communication and Information Technology in Nepal has introduced a provision in the draft bill on information technology and cyber security, requiring aspiring entrepreneurs to obtain approval from the IT Department before launching any IT business.

The draft emphasizes the necessity of IT Department approval before commencing any venture related to information technology, alongside the obligation to inform the department about registration and cancellation particulars.

Previously, businesses could operate by registering with the company registrar’s office. However, if this bill is passed and enacted, securing approval from the department will become a prerequisite for initiating IT businesses in Nepal.

The Ministry of Communication and Information Technology has invited stakeholders to provide feedback and suggestions on the draft bill via email at info@mocit.gov.np within the next 15 days.

The proposed legislation aims to amend and consolidate existing laws to foster the development, promotion, and regulation of information technology within Nepal. It also seeks to regulate electronic records and signatures, provide electronic public services, ensure cybersecurity, protect sensitive information infrastructure, and address cybercrimes.
